When you bring proceedings for possession
Having gone to all this trouble to deal with this situation properly, when you go to court (if you go to court – your tenant may agree to move out early!) you want the Judge to be aware that you have complied with the regulations.
Most section 21 claims are brought using the accelerated procedure. The court forms for this procedure leave no space for you to add anything, so the best place to put this is in an attachment to the form. In this case, I suggest you attach an additional statement explaining to the court what you have done.
When completing the court form therefore, I suggest that at paragraph 7 you cross out sub paragraphs (i) to (iii) and write in the white space on the right ‘See annexed statement marked D’.
